‘No movement on Sunday, no legal basis’ - Atty. Comafay regarding Mayor Estraňero’s pronouncement


Tabuk City, Kalinga – Lawyer Errol Comafay Jr., one of the known critics of City Mayor Darwin Estrañero clarified that the pronouncement of the mayor on no movement on Sundays while the city is under ECQ has no legal basis.


Earlier this week, during his radio program, Magandang Tanghali Mayor this January 29, Estrañero announced that there shall be no movement on Sundays during the duration of ECQ to pave way for disinfection of establishments that are allowed to open.


He said that the 43 barangays were instructed in a meeting about the matter, “... iti Sunday ket close tayo kasla metlang diay napalabas nga ECQ so dagiyay iti naibilin kadagiti barangay captains tayo,” he said.


Meanwhile, in a message, Atty. Comafay pointed that this has no legal basis as it was not included in the executive order signed by the mayor.


“The pronouncement of the Mayor that there should be no movement on Sundays during the ECQ has no legal basis. The very executive order signed by the Mayor did not prohibit people from going out on Sundays,” he said.


“The Mayor should read and understand the executive orders that he signs. He should not make baseless pronouncements since it only confuses the frontliners who are implementing his executive order,” he added.


Further, he stressed that the people should not be prohibited from going out to perform essential things without any legal basis.


“Essential businesses should be allowed to open even on Sundays. Farmers should be allowed to work even on Sundays,” he said.


The Enhanced Community Quarantine in Tabuk City will end on February 8, 2021. Additionally, President Rodrigo Duterte on January 29 had placed the entire Cordillera Administrative Region under General Community Quarantine from February 1 to 28, 2021.
