Bulanao Norte pushes to impose penalty against improper solid waste management

Tabuk City, Kalinga – Aiming to enhance ecological balance in the community through sustainable and integrated waste management, Bulanao Norte headed by Punong Barangay Atty. Henry Tubban Jr. is seeking the approval of their proposed Comprehensive Solid Waste Management ordinance.


The ordinance contained in Barangay Ordinance No. 01 series of 2022 was transmitted to the city council led by Acting Vice-Mayor Atty. Zorayda Mia Wacnang on February 10, 2022.

The measure was referred to the Committee on Environment.


In the ordinance, it seeks to mandate the proper segregation and collection of wastes in residential houses, commercial establishments, institutions, industries of any kind, and agricultural areas situated within the territorial jurisdictions of Bulanao Norte.


The proper segregation is given importance to ensure cleanliness and minimize pollution arising from harmful gases, smoke particulates, polluted runoffs in water sources or supplies, and hazardous substances.

Requirements for Segregation and storage of solid waste pending collection


Under the ordinance, there shall be a separate container for each type of waste. The container shall be properly marked or identified as biodegrable/compostable or ‘nabubulok,’ recyclables or ‘di-nabubulok na maari pang pakinabangan,’ and residuals and special waste or ‘di-nabubulok na di na mapakikinabangan.’


The solid waste container such as plastic bags shall be properly marked for on-site collection.

Section 12 of the proposed measure stated that the time of dumping ecological solid waste at the collection sites shall be from 5a.m. to 6a.m. of the scheduled garbage collection.


Prohibited Acts, Fines and Penalties


Prohibited acts are penalized with fines ranging from P150 to P500 or render of community service.


Among the prohibited acts include bringing out and dumping of garbage outside of collection day and proper time of dumping for collection, indiscriminate dumping garbage, littering in public places.


The open and indiscriminate burning of residual and special waste, causing or permitting the collection of non-segregated waste, and unauthorized removal of recyclable materials intended for collection are likewise prohibited.


Individuals caught doing the aforementioned prohibited acts will receive a warning for the first offense. The second offense will be fined with P250 or render of five (5) days community service or both, while the third offense will be penalized for an amount of P500 or render five (5) days community service.

The proposed fines for subsequent violation will be P1,000 or render 20 days of community service.


Meanwhile, households or establishments that do not provide receptacles or containers will pay P150 to P250 or render one day to five days of community service, or both.


Further, establishments, institutions, households, and other occupants who do not keep their surrounding areas and immediate premises clean will be fined P150 to P500 or render three to 10 days of community service.


Violators shall not be given Barangay Clearances until they have paid or served their fines or penalties. Their names shall be posted at conspicuous places in the barangay.


Any citizen may file an appropriate or criminal action in the barangay against any person who violates or fails to comply with the provisions of the ordinance.
