Tabuk City Administrator explains why Real Property Tax should be paid by the LGU

Tabuk City, Kalinga - A city official explained in a press forum held Thursday, October 21, 2021, why the Local Government Unit (LGU) of Tabuk should pay the Real Property Tax (RPT) of the planned building of a mall as part of the development of the Bulanao Public Market.

In the forum where representatives of those opposing the project were given a chance to inquire and raise questions about the LGU and XRC Developers agreement, Attorney Errol Comafay Jr. reiterated that there is Resolution No. 18 approved by the SP members of Tabuk in February last year giving the authority to Mayor Darwin Estranero to enter into a Contract of Lease with XRC Mall Developers which states the Bulanao Public Market development.

Comafay reminded that the authority given to the mayor is subject to the categorized eight (8) conditions stated in the resolution, one of which stated that the XRC shall pay the RPT to the LGU during the lease period.

“Doon sa resolution ng Sanggunian (Panlungsod), may mga kondisyones doon na binanggit na dapat mailagay doon sa contract of lease, isa na roon ay ang kondisyon na ang real property tax para sa mga gusaling itatayo ng XRC ay dapat bayaran ng XRC.”

Comafay then said this is contrary to the Lease Contract agreement draft signed by both the mayor and AMRC Holding Company Chairman, Alexander Cruz.

“Ang katanungan ko po, doon sa contract of lease na pinirmahan ni mayor at ng XRC, ang sinabi doon ay ang pamahalaang lungsod o ang city government ng Tabuk ang aako sa pagbabayad ng real state taxes for the land and building and pati pa po documentary stamp tax… Bakit pumayag ang pamahalaang lungsod, bakit pumayag si mayor na ang pamahalaang lungsod ang aako sa real property taxes na dapat bayaran ng XRC kahit na ito ay isa sa mga kondisyon na binigay ng Sanggunian (Panlungsod) para sa pagbibigay ng pahintulot sa kanya na pumirma ng kontrata. Pakisagot nga po,” Comafay asked.

City Administrator Noli Tenedero explained that the RPT payment should be shouldered by the LGU being the owner of the building and the Bulanao Market lot.

XRC Head of Business Development Ismael Bayato meantime seconded Tenedero’s statement, further saying that the XRC is merely to operate and manage the mall.

Tenedero: Ang tanong mo, bakit ang city government ang magbabayad ng real property taxes? Nais ko ring ibahagi o sabihin na ang lupa ay lupa ng City Government kaya tayo ang may-ari nun. Ang building at ang structure na ipapatayo ng XRC mall ay pag-aari ng City Government that is an improvement sa lupa, kaya sa account natin maicha-charge yan. Yon ang ano. Ang XRC mall ay sila lang ang mago-operate at magma-manage kaya yung RPT na sinasabi mo, ‘yung real property taxes will be for the account, sa account ng city government yan,” Tenedero explained.

Bayato: Totoo po ‘yung sinabi ng ating butihing city admin na ang pag-aari po ng lupa at ng building eventually ay ang city at katunayan po niyan meron din po tayong tinatawag na beneficial user karagdagan po na kahit po kami ang nagtayo ito po ay hindi pwedeng maging pag-aari ng developer, kami lamang po ay mago-operate at magma-manage na efficiently ho naming naisasagawa base sa mga naging experience namin sa ilang community mall din po na aming naitatag at gusto ko rin pong idagdag na ang tinatawag nating renovation ng structure ito po ay isasagawa ng mga malalaking tenants sa mall katulad po ng sa supermarket, department store at hindi po nade-deprive ang city ng tinatawag nating renovation permit or construction permit including mga business taxes na mapupunta rin po sa local government. To make the long story short din po, ako po’y hindi ganon nakakasigurado pero sa naririnig ko po sa iba, the local government cannot tax itself kasi nga po paga-ari niya po ‘yung kanyang lupa at ‘yung structure na building.
